Bunnings Trade Terms and Conditions of Sale

These terms and conditions (Trade Terms and Conditions) apply to any Products and services that you purchase using, or in connection with, a Bunnings PowerPass account.

1. Quotes, Estimates and Orders

a) Unless the quotation/estimate specifies otherwise, it is valid for 30 days and for the full quantity of Products specified in the quotation/estimate only. The quote/estimate supersedes all previous quotes/estimates.

b) If you wish to change your order or product specifications before delivery, a revised quote/estimate will be provided.

c) Subject to availability of the Products, we will be bound to supply you the Products when Bunnings accepts your order (but not before), and you will then be bound to pay for them.

d) Deliveries or collection of Products beyond 30 days of Bunnings accepting your order may result in Bunnings providing a revised quotation/estimate in accordance with clause 13 below.

e) Online orders will be regarded as accepted once payment has been processed and you have received an email order confirmation from us. All orders accepted by Bunnings will be pursuant to these terms and conditions, unless agreed otherwise.

2. Payment

a) Unless otherwise specified, payment must be made in accordance with the terms and conditions of your PowerPass account.

3. Delivery

a) If you have ordered your Product on the Website or PowerPass App and Products are to be delivered, the delivery option selected by you and the applicable estimated delivery times will be shown in your Checkout Summary.

b) In an aim to have your products to you within these timeframes, items in your order may need to be sourced from multiple locations and may arrive in more than one delivery. Multiple deliveries/split orders will only be used when an order is unable to be filled by an individual store due to product limitations in our Warehouses or Trade Centres. If your order arrives in multiple deliveries, you will only be charged for one delivery cost at time of purchase.

c) Trade orders that are required to be delivered in whole will not be subject to multiple deliveries. Where the quantity of Products ordered is not available from a single store, the order may be consolidated to arrive in one delivery, which may take longer than the usual delivery time referred to on the Bunnings website. Our team will contact you after you place your order to provide details of the new estimated delivery timeframe.If the longer delivery time does not suit, you will be given the option to cancel your order and have amounts paid refunded or credited to your PowerPass account, or have it delivered in multiple deliveries.

d) You will be notified via email once your Products have been dispatched. If your order is divided across multiple locations for fulfillment, you may receive contact from multiple Warehouse or Trade Centre locations regarding delivery of your Products.

e) If delivery is offered by Bunnings, a charge for delivery to your home or premises will apply. Bunnings will give you an estimated delivery date/time but, subject to any rights you have under the Australian Consumer Law, we are unable to accept liability for delay in delivering the Products which is beyond our reasonable control.

f) If Products have not been delivered within a reasonable time (depending on the nature of the Products and the delivery address), please contact us if you wish to cancel your order for those Products and request a refund.

g) You must ensure there is clear and safe access for delivery. Please ensure there is a person present at the delivery premises who is authorized by you to accept delivery. If there is not, unless you have explicitly advised us not to leave the products, we will leave the products at your premises if we consider it is safe and appropriate to do so.

h) If the delivery contractor arrives at the agreed time but is unable to deliver the products or considers that it is unsafe or inappropriate to do so, you may be required to pay for re-delivery later. Some products may require extra delivery personnel which will incur an additional charge.

i) We will deliver your Products at ground level at the delivery premises unless you have arranged otherwise with us. Title in the Products passes upon full payment. The Products are at your risk after delivery.

j)  To the extent permissible at law, including the Australian Consumer Law, liability for damage to any property occurring in the course of delivery, except to the extent that any loss or damage is caused by our negligence, wrongful act or wilful misconduct, will not be accepted.

4.Abandoned Products

a) If you fail to collect or call up delivery of your order as agreed or within a reasonable time afterwards, then, subject to applicable laws, Bunnings may invoice you any amounts owing for the Products, including specially ordered and custom made Products, where Bunnings is not reasonably able to return the Products to stock and resell them. We will give you written notice when we do this.

b) The order will be deemed fulfilled once invoiced or cancelled when returned to stock. Invoiced orders will be available for collection, or delivery by arrangement, for 30 days from invoicing your account.

c) If, despite further reminder from Bunnings, you do not collect or arrange delivery of the products within that period, to the extent permitted by law, Bunnings will treat the products as abandoned/uncollected Products and may take any action that it deems reasonably necessary to dispose of the Products, for which Bunnings will bear no liability to you whatsoever.

5. Collection

a) If you choose to collect your Products from our premises, we will advise you when your Products are available for you to collect.

b) If Products are being collected, you must collect them within 10 days after we inform you that they are ready for collection. You will need to show proof of ID to verify your identity upon collection. If you do not collect the Products within the applicable time period, then unless you make arrangements with us for late collection, we may cancel your order (see clause 13 below).

6. Warranties

a) In addition to manufacturers' guarantees on selected Products, if you are a consumer within the meaning of Australian Consumer Law, you may have additional rights under the Australian Consumer Law. Under the Australian Consumer Law, consumers may be entitled to a replacement or refund for a major failure and for compensation for other reasonably foreseeable loss or damage. Consumers are also entitled to have the Products repaired, or replaced if the Products fail to be of acceptable quality and the failure does not amount to a major failure. All other warranties are excluded, except those that are non-excludable in law, including Australian Consumer Law.

b) Subject to Australian Consumer Law, where Products supplied are not of a kind ordinarily acquired for personal, domestic or household use, our liability in respect of those Products is limited to refunding the price or replacing or repairing the Products and we exclude liability for indirect or consequential loss (indirect, special, consequential or exemplary damages or losses, including loss of opportunity, revenue, profit, contract, goodwill and loss arising from business interruption, e.g. contractor time on site). Bunnings will not be liable for damage, loss or injury suffered as a result of any person failing to follow instructions relating to the Products, modifying them, failing to appropriately maintain or store them or using them for an unintended purpose. To assist us in resolving any problems you may experience, please inspect the Products upon taking delivery and report any shortage, discrepancy, damage, wrong specification or similar problem to us as soon as you become aware of it, and within 7 days of delivery (otherwise, subject to Australian Consumer Law, we may not be liable for that problem later).

7. Cancellation & Returns

a) We will endeavor to assist you if you wish to cancel your order or return Products unused in accordance with Bunnings’ Returns Policy on our website.

b) Some Products, including specially ordered, custom made Products and Greenlife Products, are non-returnable unless a warranty or guarantee is breached (further information can be found on trade.bunnings.com.au/returns). Subject to the Australian Consumer Law, customers may be required to pay for loss we incur as a result (for example, handling/transport costs or any re-stocking fee charged by our supplier).

c) We reserve the right to cancel any order (in full or part) where: (i) you are in breach of your payment obligations to Bunnings; (ii) you are purchasing Products for the purposes of resale or resupply (other than where you are a builder or tradesperson and you are resupplying the Products to your customers in the course of that trade); (iii) Bunnings becomes aware after order confirmation of shortages, delays or that the Product is out of stock or not reasonably available from Bunnings' suppliers at the required delivery time or for the quoted price; (iv) you fail to collect or call up delivery of your order as agreed or make alternative arrangements acceptable to Bunnings; (v) collection of the Products does not occur within 10 days of notification that they are available for collection, or delivery does not occur within 30 days of acceptance of an order by Bunnings and no alternative arrangement has been agreed (other than where caused by Bunnings), or (vi) there has been a genuine pricing or product description error by Bunnings or its supplier.

d) We will refund any amount already paid in respect of any cancelled order, other than where the order is cancelled (see clause 4) because you failed to collect it or call it up for delivery on or by the agreed delivery date and Bunnings is not reasonably able to return the Products to stock or resell them, such as in the case of a special order or custom made Product which cannot reasonably be resold or returned to the supplier (and in the case of part cancellation of an order, we will refund the amount paid that relates to the cancelled portion of the order).

8. Privacy

a) Bunnings collects your personal information to allow us to supply you with Products. You can read more about how we handle your personal information (including marketing and any disclosure to third parties) in the Bunnings Privacy Policy. By providing us with your personal information you agree to this policy.

9. Third Party Installation

a) Where you arrange for a third party to install Products supplied by us, you must contract separately with that third party. Bunnings will not be liable for any installation services provided by a third party, unless Bunnings engages the third party.

10. GST

a) If Products are being exported out of Australia and you can confirm that this will be within 70 days of purchase, then GST on the Products will not be charged. You will be required to provide the relevant export documentation, i.e. Bill of Lading and customs clearance documentation, within 70 days of purchase for this to be valid. If you do not provide the relevant documentation within this time frame, then GST on the purchase will be charged to your account.

11. Other terms and conditions

a) if you have a PowerPass cash or credit account with Bunnings, then the terms and conditions of the applicable account, the PowerPass terms and conditions of use, and any other terms advised to you by us in writing, apply in addition to these Trade Terms and Conditions.

b) These Trade Terms and Conditions, together with the terms and conditions referenced at 11a above and Bunnings policies as at the date of order (available on the Bunnings website), including our returns and refunds policy apply to the exclusion of all other terms and conditions, including any terms and conditions contained in any purchase order or other document provided by you to us.

c) Where Bunnings accepts your order, it does so on the basis of these Trade Terms and Conditions of Sale and any clarifications, such as inclusions and exclusions, included in its quote, unless expressly provided otherwise in writing.

12. Errors or omissions

a) Bunnings takes all reasonable care in preparing quotations but is unable to accept any responsibility for any genuine errors or omissions in the quotation or any errors or omissions in the plans, drawings or specifications you provide to us for the purpose of quoting. It is your responsibility to carefully check and confirm all items, quantities, and measurements before placing an order.

b) Where Bunnings accepts any order placed, unless specifically agreed otherwise, it does so on the basis that you bear full responsibility for ensuring the accuracy of all items, quantities, and measurements and that they comply with any plans, drawings, or other specifications provided.

13. Revised quotation

a) Where delivery or collection of Products in an order accepted by Bunnings does not take place within 30 days of acceptance of that order (other than where this is caused by us), or where later delivery or collection dates beyond 30 days from the date of acceptance of an order are required by you, Bunnings reserves the right to cancel the order prior to delivery. Where Bunnings does this, it may provide you a replacement quotation for supply of the Products at a revised price, which you may accept or reject.

14. Greenlife Product Terms and Conditions

The following additional clauses apply to all purchases of Greenlife Products and shall take precedence over clauses 1-13 above to the extent of any inconsistency.

(i) Returns

(a) Subject to your rights under the Australian Consumer Law, we do not accept change of mind returns for Greenlife Products. We strongly encourage you to review the product choices available for project suitability before placing an order.

b) Greenlife Product must be thoroughly inspected at the time of purchase in store or at time of delivery. Any issues including, but not limited to damage, pests and quality should be raised at the time in store, or as soon as possible within 48 hours after delivery to site. Notification must be made in writing, including a description of the issue and photos depicting the problem.

c) Once Greenlife Products have left our premises multiple factors outside our control can affect plant quality, such as weather, pests & disease, environmental impacts and watering.

d) All enquiries that are received within 48 hours of delivery regarding product defects/issues will be investigated by our team and replacement product or a refund may be arranged if deemed appropriate by us having regard to the circumstances.

* Please speak to your Sales rep before bringing any products back to a store.

(ii) Deliveries

a) You are required to have persons on site to sign for receipt of goods and to assist with unloading of Greenlife Products. Failure to do so may result in the truck leaving and you may be subject to a redelivery fee of up to 12% of invoice value but no less than $110.

b) Any specifics for vehicle requirements due to site layout/terrain must be communicated in advance so appropriate arrangements can be made. Vehicle size and type will depend on the type of Greenlife Product being delivered and the quantity.

c) Every effort will be made to consolidate Greenlife Product deliveries into one truck, however in certain circumstances more deliveries may be necessary. Standard applicable charges for delivery fees will be included in the quote prior to confirming the order.

(iii) Cancellations

a) Orders of Greenlife Product cannot be cancelled within 5 business days of the specified delivery date.

b) Subject to Australian Consumer Law, any orders of Greenlife Product that are required to be cancelled after a purchase order has been received and confirmed and outside of this timeframe will be subject to 100% cancellation fee of the order dependant on grower approval for a return.

(iv) Variations

a) Requests for variations after placement of an order for Greenlife Product must be made in writing and must be agreed to and approved by both parties to have effect and are subject to availability.

b) Greenlife Product availability and supply may change at any time due to unforeseen circumstances. Bunnings will endeavour to source and supply all stock on the order at the agreed upon price, however if unable to do so, the order will be re-quoted based on current availability and pricing. Any changes to product or price of Greenlfie Product will be communicated to you and will not be actioned until your approval is received, which may result in delay of supply for affected Greenlife Products.

(v) Delays

a) Customer requested delays that require delivery/pickup of Greenlife Products to be rescheduled must be communicated to the relevant sales team member (such as the account manager, landscape specialist, trade specialist or team member) as soon as possible, and no later than 24 hours prior to the specified date and time.

b) Where you are unwilling or unable to collect the Greenlife Products or accept delivery on the nominated date, additional fees will apply and the storage of the Greenlife Products will, subject to Australian Consumer Law, be made at your risk and cost.

c) in the event of a delay requested by you, any deterioration in the quality of the Greenlife Products will not absolve you from your obligation to accept the products at full price. Bunnings will not be held accountable for any loss of quality due to the delay, unless and to the extent caused by its negligent act or omission.

d) Delays or non-collection of Greenlife Products beyond 14 days and less than 30 days from the agreed delivery/pick up date may result in alterations to the product supply such as substituting, change of pot size and/or holding fees (cost for on going care and maintenance of the Greenlife Products) or restocking fees.

e) Delays or non-collection of Greenlife Products of 30 days and beyond without a written and approved agreement on the new supply date will result in the Greenlife Products being disseminated or disposed of. Subject to Australian Consumer Law, you will be liable to cover all costs that are unable to be recovered up to the total value of the order.

(vi) Perfect Plant Promise

a) The Perfect Plant Promise does not apply to the purchase of: (i) seedlings; or (ii) Greenlife Product (other than seedlings) in commercial quantities.

Definitions

- Bunnings, we, us or our means Bunnings Group Limited;

- Checkout Summary means the summary of your purchase of Product/s presented to you prior to confirmation of your purchase on the Website;

- Greenlife Product means plants and seedlings available for purchase from Bunnings;

- Product means any goods and related services available for purchase from Bunnings, including Greenlife Products where the context requires;

- Website means the Bunnings Trade website available at https://trade.bunnings.com.au/
