1. Information on how to enter and prize details form part of these Terms and Conditions. Entry into the Promotion is deemed acceptance of these Terms and Conditions.

2. The promoter is BUNNINGS GROUP LIMITED (ABN 26 008 672 179) of Building 3, 570 Swan Street, Burnley, VIC, 3121, telephone number 03 8831 9777 (“Promoter”).

3. Entry is only open to Bunnings Trade customers who:

a) reside in Australia;

b) are aged 18 years or over

c) at 01/09/2024 are the registered owner of an existing and valid Bunnings PowerPass commercial account (either Standard, Apprentice, Owner Builder, Credit or 30-day account) (“PowerPass Account”), or sign up for a PowerPass Account during the Promotional Period and prior to entering; and

d) can take the prize between 24/10/2024 and 28/10/2024 (inclusive).

4. Directors, management and the employees of the Promoter, retailers and suppliers associated with this Promotion and the immediate family members of those individuals are ineligible to enter. Immediate family means any of the following: spouse, child, parent, grandparent, brother or sister.

5. The Promotion will commence at 12.01am AEST on 12/09/2024 and closes at 11:59pm AEDT on 13/10/2024 ("Promotional Period”).

6. By participating in this Promotion, entrants consent to receiving marketing material and communications from the Promoter and Supercars (ABN 94 077 053 484) in relation to this Promotion.

7. Entrants must not have an overdue balance owing on their PowerPass Account at the date of winner determination (on 15/10/24) to be eligible to win the prize.

8. To enter, an entrant must, during the Promotional Period:

a) first, register by visiting https://trade.bunnings.com.au/powerpass/powerpass-supercars-competition or by scanning the QR code on advertising materials in store or in the PowerPass App to follow the prompts to the registration page, and input the requested details (including your full name, a valid email address, mobile number, nearest Bunnings Store & PowerPass Account Number, and agree to these Terms and Conditions by ticking the relevant tick box (”Registration");

b) after completing Registration, download the PowerPass App (or open it, if already downloaded) on your smartphone and link your PowerPass Account; and

c) make any purchase through the PowerPass App to get one entry into the draw.

9. If the purchase on the PowerPass Account is not made by the account holder, the purchaser must be authorised by the account holder to make the purchase. If there is a dispute as to the identity of an authorised user of a PowerPass Account, the Promoter reserves the right, in its sole discretion, to determine the identity of the user and/or PowerPass customer.

10. The Promoter reserves the right, at any time, to verify the validity of entries, authorised users and PowerPass Account holders (including an entrant’s age and place of employment). The Promoter may, at any time, require an entrant to produce documentation to establish to the Promoter's reasonable satisfaction the validity of a person’s entries and/or verifying their identity (including documentation establishing your identity, age, place of residence and place of employment) and the Promoter reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has materially breached any of these Terms and Conditions (including if the individual is unable to take the prize on the relevant dates), tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the Promotion. Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.

11. There will be 1 draw conducted which will take place at 12pm AEDT on 15/10/2024 at Gadens, Level 13, 447 Collins Street, Melbourne Vic 3000 (“Draw”). The first valid entry drawn randomly from all valid entries received during the Promotion Period will win the prize. At the draw, additional entries may be drawn and recorded in order, in case a winning entry/entrant is deemed invalid, or a prize is unclaimed (“Reserve Entrants”).

12. The winner will be notified in writing and by telephone within two (2) business days of the Draw and their first initial, last name, postcode and their business name (as registered on their PowerPass Account) will be published online at https://trade.bunnings.com.au/powerpass/powerpass-supercars-competition from 16/10/2024 for a period of 28 days.

13. There is 1 prize available in this promotion. The prize is a trip for the winner and 1 adult companion to the Gold Coast, Qld which consists of the following (value including GST):

(a) 2x return economy airfares (including airfare taxes) from the winner’s nearest Australian capital city to Coolangatta, Qld and return transfers between Coolangatta airport and the accommodation valued at up to $2,000 (flights and transfers are not included if the winner lives within a reasonable driving distance to the Gold Coast, as determined by the Promoter, and if so, the winner and their companion must make their own way to and from the accommodation location at their own cost);

(b) 4 night/s accommodation for 2 people in a minimum 3-star hotel at the Gold Coast (as reasonably determined by the Promoter) valued at $2,000; and

(c) a Supercars experience package (for 25-27 October 2024) including Grid Walk for two (2) valued at $1,500, MCBE Course Rides for two (2) valued at $2,000, 3-day Paddock Club entry for two (2) with hospitality valued at $5,700 & A Behind the Scenes Tour for two (2) valued at $500.

The prize is subject to any applicable law or guidelines including in relation to a pandemic, any travel/government restrictions/directives, border closures, health advice and the like.

By accepting or participating in the prize, the winner must ensure their companion accepts these Terms and Conditions and will be liable for any breaches of these Terms and Conditions by their companion as if the winner was in breach them self.

15. The prize will be awarded to the registered account holder named on the winning eligible PowerPass Account who may, in their absolute discretion, allocate the prize to any employee (of the business associated with their PowerPass Account) that is over the age of 18 years. Such nominated person will be known as the ‘winner’ for the purposes of these Terms and Conditions and is deemed to accept these Terms and Conditions upon agreeing to be allocated the prize.

16. As the prize is event based and must be taken 24-28 October 2024 (inclusive), the winner must claim the prize by 3:00pm AEST on 17/10/2024. If the prize is not claimed by 3:00pm AEST on 17/10/2024, the relevant entry (including any nominated person associated with the entry) will be discarded, and the Promoter will re-award the prize to a to Reserve Entrant or if necessary, will carry out a re-draw at 3:30pm AEST on 17/10/2024 at the same place as the original draw. Any such winner will be notified in writing and by telephone within two (2) business days and the first initial, surname, postcode and business name will be published online at https://trade.bunnings.com.au/powerpass/powerpass-supercars-competition from 17/10/2024 for a period of 28 days.

17. The Prize is subject to the standard terms and conditions of individual prize and service providers including but not limited to conditions of entry into any event venues, or conditions of ticket validity and any restrictions on ticket on-sale or transfer.

18. The Promoter will not be responsible or liable for any loss, damage or injury suffered by any winner or their companion as a result of accepting and/or using the prize, to the full extent permitted by law. This includes but is not limited to any tax implications arising from the prize.

19. Spending money, other meals not specified, travel insurance, items of a personal nature, transport to and from departure point, in-room charges and all other ancillary costs are not included. Event tickets can only be used once and will be deemed invalid if copied. The Promoter does not control entry to the relevant event location. The winner must keep their tickets safe, and the Promoter will not replace lost or stolen tickets.

20. Prize dates cannot be changed and must be taken to coincide with the Bunnings Trade sponsored Supercars event 25/10/2024 - 27/10/2024 and is subject to booking and flight availability.

21. The winner must ensure they and their companion they have valid Australian ID and travel documentation. The winner and their companion must depart from and return to the same departure point and travel together. Itinerary to be determined by the Promoter in its absolute discretion. The winner may be required to present their credit card at the time of accommodation check in.

22. The winner accepts (and must ensure their companion accepts) that some aspects of the prize may be inherently risky and that the prize may involve dangerous activities. If specified, in order to participate in the activity/activities awarded as part of the prize, the winner and their companion must comply with any applicable conditions (e.g. height, weight, health and fitness requirements). The winner must ensure that they and their companion are healthy and fit enough to take the prize and participate in the elements of the prize. The winner and their companion must follow all requirements of the people responsible for managing the relevant activity/ies.

23. The winner and their companion must, if required by the Promoter, sign disclaimer and release forms provided by the Promoter in favour of the Promoter and other parties before taking the prize. If the winner or their companion do not sign, their entry will be deemed invalid and the winner will lose any entitlement to the prize.

24. If any dispute arises between you and the Promoter concerning the conduct of this promotion or claiming a prize, the Promoter will take reasonable steps to consider your point of view, taking into account any facts or evidence you put forward, and to respond to it fairly within a reasonable time. In all other respects, the Promoter’s decision is final and no correspondence will be entered into.

25. If any part of the prize is unavailable for any reason beyond the Promoter’s reasonable control, the Promoter reserves the right to substitute another element of equal or greater value, subject to any directions from a regulatory authority. The Promoter accepts no responsibility if one or more of the events or activities awarded as part of the prize are abandoned, called off or postponed for any reason beyond the Promoter's reasonable control.

26. Total prize pool value is up to $13,700 including GST. The values are the recommended retail value and are correct as at 10th July 2024. The prize, or any unused portion of the prize, is not transferable or exchangeable (unless otherwise specified) and cannot be taken as cash.

27. Subject to clauses 16 and 28, if for any reason the winner does not take the prize by the time stipulated by the Promoter, then the prize will be forfeited and if forfeited, the Promoter will not be liable. If you forfeit the prize or any element of the prize for whatever reason, you will not be given cash or any alternative prize as a substitute.

28. As a condition of accepting the prize, the winner consents to the Promoter and Supercars using their name, likeness, image and/or voice (including photograph, film and/or recording of the same) without remuneration in any media related to the marketing and promotion of the Supercars event or the Promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter in connection with the Promotion.

29. If the winner or their companion, in the reasonable opinion of the Promoter, behave aggressively or offensively, or behave in a manner which may diminish the good name or reputation of the Promoter or any of its related entities or the agencies or companies associated with this promotion, is contrary to law or is otherwise inappropriate, the Promoter may cancel the prize or restrict the winner (and their companion) from participating in any elements of the prize, at its discretion.

30. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to a pandemic, technical difficulties/failures, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law:

a. to disqualify any entrant or entries;

b. extend, suspend, or cancel the Promotion, as appropriate (subject to any directions from a regulatory authority).

31. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted on behalf of that entrant invalid.

32. Social media platforms, including but not limited to, Facebook, YouTube, Instagram, Tik Tok or Snapchat, may be used to advertise or promote the Promotion. The Promotion is in no way sponsored, endorsed or administered by those social media platforms, and any questions or comments should be directed only to the Promoter. Entrants completely release any relevant social media platforms from any and all liability.

33. You may have consumer rights under statute including under the Competition and Consumer Act 2010 (Cth), which may be relevant to any issue or problem you encounter in relation to this promotion and cannot be excluded or restricted. Nothing in these Terms and Conditions excludes or restricts those rights. See www.accc.gov.au for more information about those rights. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify any such rights, or other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion.

34. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by an entrant; or (f) taking/using a prize.

35. The Promoter is bound by the Australian Privacy Principles contained in the Privacy Act 1988 (Cth). A copy of the Promoter’s privacy policy can be viewed at https://www.bunnings.com.au/policies/privacy-policy. To request access to, or to update or correct, personal information the Promoter holds about you, entrants can contact the office of the Promoter at the address set out in clause 2 or view the Privacy Policy for instructions. The Privacy Policy also contains information about how entrants can complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter will not disclose entrant’s personal information to any entity outside of Australia.
